Spicy AI provides AI-powered creative tools, including but not limited to:

• Character Chat: Create and interact with AI characters and companions.
• Image Generation: Text-to-image, image-to-image, and AI image editing.
• Video Generation: Text-to-video and image-to-video creation.
• Talking Avatars: Generate spoken avatar performances from text or images.
• Character Creation: Customize personality, appearance, and story for your characters.
• Other related AI features, tools, and community capabilities we may add over time.

4.2 Service Changes

We may innovate, test, and improve the Service continuously. We reserve the right to:

• Modify, update, suspend, or discontinue the Service (or any part or feature) at any time, with or without notice.

Spicy AI is not liable to you or any third party for any modification, price change, suspension, or discontinuation of the Service.

5.1 Permitted Use

Spicy AI grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for lawful purposes in accordance with these Terms and applicable laws.

5.2 Prohibited Conduct

To protect the platform and our users, you agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive source code or underlying models from the Service.
• Use bots, scrapers, crawlers, or other automated systems to access or copy the Website without our prior written consent.
• Interfere with, disrupt, or place an unreasonable load on the Service or related infrastructure.

Rules for prompts, uploads, generated content, and prohibited themes are set out in our Content Policy. Violations may result in content removal, account suspension, or permanent termination.

6.1 Platform Intellectual Property

All rights in the Website, the Service, and materials provided by Spicy AI (including software, algorithms, branding, text, graphics, and trademarks) are owned by Spicy AI or its licensors. Except as expressly stated, no rights are granted to you.

6.2 User Input Content

You retain ownership of content you input (prompts, images, videos, character settings, and other materials), subject to the license below. You represent that you have the necessary rights and permissions for all materials you provide.

6.3 Generated Content

As between Spicy AI and you, rights in content generated through the Service ("Output") belong to you, to the extent permitted by law.

User Responsibility: You are solely responsible for your Output and for ensuring it does not infringe third-party rights or violate applicable law.

6.4 Limited License Granted to Platform

By submitting content to the Service, you grant Spicy AI a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, distribute, and display that content solely to:

• Operate, maintain, secure, and improve the Service.
• Train and optimize models and algorithms to improve quality and safety.
• Conduct branding and marketing, with separate consent before publicly displaying your specific content for marketing.

6.5 User Feedback

Feedback, suggestions, or ideas you provide to Spicy AI may be used by us without restriction or compensation.

7.1 No Warranty on Output

Spicy AI uses evolving AI technology. We do not guarantee the accuracy, completeness, legality, or suitability of any Output. Output may contain errors, biases, or unintended similarities and does not represent our views.

7.2 Third-Party Rights & Copyright Risks

We do not warrant that Output is free of third-party intellectual property claims. Because AI generation is probabilistic, Output may resemble existing works. You are responsible for clearance and legal review before commercial use.

7.3 User Responsibility

You assume all risks from using Output. Spicy AI is not liable for third-party claims or damages arising from your use of generated content.

8.1 Platform Credits

Spicy AI sells one-time credit packs that can be purchased with cryptocurrency. Credits pay for eligible features on this site, including chat, images, video, and avatars. We do not sell subscriptions for platform credits.

Current credit packs, usage rates, and free-tier rules are published on our Pricing page.

Once credits are added to your account, the purchase is considered delivered. Credits are digital, non-refundable, and non-cashable except where required by law.

8.2 Third-Party API Keys

If you prefer credit card or other payment methods, you may purchase an API key from a supported third-party provider and bind it in your account.

Manage your key in Settings.

Spicy AI is not the seller of third-party API keys. Billing, refunds, and disputes for keys purchased elsewhere are handled solely by the third party.

8.3 Payment Finality

11.1 Third-Party Links

The Service may link to third-party websites or services. Spicy AI does not control and is not responsible for third-party content, policies, or practices.

11.2 Third-Party Providers

The Service relies on third-party providers such as payment processors, cloud infrastructure, AI model providers, and API key vendors. Your use of those services may be subject to their separate terms.

12.1 Service "As-Is"

The Service is provided on an "as is" and "as available" basis. Spicy AI does not warrant uninterrupted, error-free, or secure operation, or that the Service will meet your specific requirements.

12.2 Warranty Disclaimers

To the maximum extent permitted by law, Spicy AI disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13.1 Indirect Damages

To the maximum extent permitted by law, Spicy AI is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or use.

13.2 Liability Cap

Our total liability for claims arising from your use of the Service will not exceed the total fees you paid to Spicy AI in the 12 months before the event giving rise to the claim.

15.1 User Termination

You may stop using the Service or close your account at any time through the Website.

15.2 Platform Termination

Spicy AI may suspend or terminate your access at any time, including for violations of these Terms, with or without notice.

15.3 Effect of Termination

Upon termination, licenses granted to you end immediately. Fees paid are non-refundable except where required by law. Provisions relating to intellectual property, liability, and indemnification survive termination.
